Welcome to CareerTestPrep. These Terms of Service ("Terms") govern your access to and use of CareerTestPrep's services, including our website and any other software or services offered by CareerTestPrep ("Services"). Please read these Terms carefully, and contact us if you have any questions.

By accessing or using our Services, you agree to be bound by these Terms and by our Privacy Policy. If you don't agree to these Terms, do not use the Services.

Our Services are intended for users who are at least 13 years of age. If you are under 13, please do not use or attempt to register for the Services. By using our Services, you represent and warrant that you meet this age requirement.

If you are between 13 and 18 years of age, you may only use the Services with the involvement and consent of a parent or legal guardian.

We may modify the Terms at any time, in our sole discretion. If we do so, we'll let you know either by posting the modified Terms on the Site or through other communications. If you continue to use the Services after we have posted modified Terms, you are indicating that you agree to be bound by the modified Terms.

We are constantly improving our Services. We may add or remove functionalities or features, and we may suspend or stop a Service altogether.

You may need to create an account to use some of our Services. You are responsible for safeguarding your account — use a strong password and limit its use to this account. We cannot and will not be liable for any loss or damage arising from your failure to comply with the above.

By providing CareerTestPrep your email address you consent to our using the email address to send you Service-related notices, including any notices required by law. You may control your user profile and how you interact with the Service by changing the settings in your settings page.

You may use the Services only for lawful purposes and in accordance with these Terms. You agree not to:

By posting Content to the Service, you grant us the right and license to use, modify, publicly perform, publicly display, reproduce, and distribute such Content on and through the Service. You retain any and all of your rights to any Content you submit, post or display on or through the Service.

You represent and warrant that: (i) the Content is yours or you have the right to use it and grant us the rights and license as provided in these Terms, and (ii) the posting of your Content on or through the Service does not violate the privacy rights, publicity rights, copyrights, contract rights or any other rights of any person.

The Service and its original content (excluding Content provided by users), features and functionality are and will remain the exclusive property of CareerTestPrep and its licensors. The Service is protected by copyright, trademark, and other applicable laws. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of CareerTestPrep.

We respect the intellectual property rights of others. It is our policy to respond to any claim that Content posted on the Service infringes the copyright or other intellectual property of any person.

If you believe that copyrighted work has been copied in a way that constitutes copyright infringement through the Service, please submit your notice in writing to hello@careertestprep.com with a detailed description of the alleged infringement.

You may be held accountable for damages (including costs and attorneys' fees) for misrepresenting that any Content is infringing your copyright.

CareerTestPrep is a free service supported by advertising. By using our Services, you acknowledge and agree that:

• • Advertisements may be displayed throughout the Services.
• • We use Google AdSense to serve advertisements. Google may use cookies and similar technologies to show you ads based on your visits to our site and other sites on the internet.
• • The nature and extent of advertising may change at any time without prior notice.
• • We are not responsible for the content of third-party advertisements displayed on our Services.

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or contact us to request account deletion.

All provisions of the Terms which by their nature should survive termination shall survive termination, including ownership provisions, warranty disclaimers, indemnity and limitations of liability.

You agree to defend, indemnify and hold harmless CareerTestPrep and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of: (a) your use and access of the Service; (b) a breach of these Terms; or (c) Content posted on the Service.

In no event shall CareerTestPrep, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content.

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

CareerTestPrep does not warrant that (a) the Service will function uninterrupted, securely, or be available at any particular time or location; (b) any errors or defects will be corrected; (c) the Service is free of viruses or other harmful components; or (d) the results of using the Service will meet your requirements.

These Terms shall be governed and construed in accordance with the laws of New South Wales, Australia, without regard to its conflict of law provisions. Any disputes shall be subject to the exclusive jurisdiction of the courts of New South Wales, Australia.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede any prior agreements between us regarding the Service.
